Delhi HC proposes shifting Sonam Wangchuk to hospital of his choice, says ‘will pass order’

The Delhi High Court on Monday proposed that climate activist Sonam Wangchuk be shifted to a hospital of his choice, indicating that it would pass an appropriate order after hearing submissions from all parties.

The observation came during the hearing of a petition challenging Wangchuk's transfer from his hunger strike site at Jantar Mantar to VMMC & Safdarjung Hospital by Delhi Police.

Court suggests consensual solution

During the proceedings, the High Court explored the possibility of allowing Wangchuk to receive treatment at a hospital of his own choosing.

The Bench observed that such an arrangement could address concerns raised by both the petitioner and the authorities while ensuring that Wangchuk continued to receive necessary medical care.

The court said it would pass a formal order after considering the submissions made during the hearing.

Plea challenges hospital transfer

The petition questioned the legality of Wangchuk's removal from Jantar Mantar, alleging that he was shifted without his consent after undertaking an indefinite hunger strike.

The petitioner argued that the activist's rights should be protected and sought judicial intervention regarding his medical treatment and continued detention at the government hospital.

Police cite health concerns

Delhi Police defended the decision to move Wangchuk, stating that the action was taken solely on medical advice after doctors expressed concern over his deteriorating health following nearly three weeks of fasting.

Authorities maintained that the priority was to safeguard the activist's life and ensure he received timely treatment.

Protest sparks political debate

Wangchuk's removal from the protest site has triggered widespread demonstrations in the national capital, including the CJP-led 'Chalo Sansad' march, and has become a major political issue during the ongoing Monsoon Session of Parliament.

Opposition parties have accused the Centre of suppressing peaceful dissent, while the government has defended its actions as necessary to protect public health and maintain law and order.
