Mamata Banerjee Demands Fresh Bengal Elections Amid EC SIR Dissent Row; Calls for CEC's Arrest

Former West Bengal Chief Minister and Trinamool Congress chief Mamata Banerjee has demanded fresh Assembly elections in West Bengal using the pre-Special Intensive Revision (SIR) electoral roll and called for the arrest and resignation of Chief Election Commissioner Gyanesh Kumar. Her remarks followed reports that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had raised objections to several decisions and orders linked to electoral-roll management and SIR. The Election Commission has rejected the suggestion of an institutional breakdown, saying that differences and observations are part of normal deliberations and that SIR-related decisions were taken unanimously.

Mamata Banerjee Demands Fresh Bengal Elections

Trinamool Congress chief Mamata Banerjee on September 23 demanded fresh Assembly elections in West Bengal using the electoral roll that existed before the Special Intensive Revision (SIR).

Banerjee also called for the arrest and resignation of Chief Election Commissioner Gyanesh Kumar, alleging that the BJP and the Election Commission had compromised the Bengal Assembly elections held earlier this year.

Her remarks came after reports of objections raised by two Election Commissioners over aspects of electoral-roll management and the SIR exercise. The Election Commission has disputed the interpretation of those internal exchanges and said that decisions relating to SIR were approved unanimously.

What Did Mamata Banerjee Say?

Banerjee alleged that the latest reports had confirmed concerns previously raised by her party about the electoral process.

She claimed that the BJP and the Election Commission had "looted" the West Bengal Assembly elections and argued that the state should hold a fresh election using the old voter list.

Banerjee also demanded immediate action against Gyanesh Kumar and called for protests across India while he remains Chief Election Commissioner. These statements represent Banerjee's political allegations and demands; they have not been established as judicial or independent findings.

Why Has the SIR Dispute Intensified?

The latest political confrontation follows a report that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had formally raised objections on at least 14 occasions over a period of around 10 months concerning decisions and orders associated with electoral rolls and SIR.

According to reports, some of the objections related to voter deletions, additions and changes to electoral-roll procedures.

The reports triggered a political response from opposition parties, which have questioned the functioning of the Election Commission and demanded action against the Chief Election Commissioner.

Election Commission Rejects Claims of a Breakdown

The Election Commission has rejected suggestions that the reported objections demonstrate a breakdown within the poll panel.

The Commission said written notes, observations, technical suggestions and internal checks are normal parts of institutional decision-making.

It also maintained that its decisions, including those concerning the SIR exercise, were taken with the approval of all three Election Commissioners. The Commission said highlighting individual internal observations without considering the wider decision-making process presents only part of the picture.

Therefore, the existence of internal objections does not by itself establish that the Commission's final decisions were unlawful or invalid.

What Is the Special Intensive Revision?

The Special Intensive Revision, or SIR, is an electoral-roll verification and revision exercise conducted by the Election Commission.

The process is intended to review voter records and identify entries requiring correction, verification or removal under applicable electoral rules.

The exercise has become politically contentious because of the scale of voter verification and concerns raised by opposition parties about possible exclusions from electoral rolls.

The Election Commission has maintained that SIR is intended to ensure that eligible voters remain on the rolls while ineligible, duplicate, deceased or otherwise invalid entries are removed.

Why Is the Pre-SIR Voter List Important to Mamata?

Banerjee's demand for a fresh election using the pre-SIR voter list is directly connected to the TMC's objections to the electoral-roll revision.

She has argued that changes to voter lists could have affected the electoral process and wants any fresh election to be conducted using the earlier roll.

The demand is a political position rather than an existing Election Commission decision or court order requiring a repoll in West Bengal.

West Bengal Assembly Election Results

The controversy comes four months after the 2026 West Bengal Assembly election.

The BJP won 207 of the 294 Assembly seats, according to reports, bringing the TMC's 15-year period in government to an end.

Banerjee's latest demand would therefore amount to holding a new election despite the recently completed Assembly election.

No fresh Assembly election has been ordered as a result of Banerjee's statement.

Opposition Parties Join the Attack on the EC

Banerjee's comments are part of a wider opposition campaign against the Election Commission.

Congress leader Rahul Gandhi has accused the BJP, RSS and Election Commission of involvement in what he calls "vote chori", while Congress president Mallikarjun Kharge has referred to an earlier Opposition effort seeking action against the Chief Election Commissioner.

Samajwadi Party chief Akhilesh Yadav, AAP leader Arvind Kejriwal and other opposition figures have also criticised the Commission over the SIR controversy.

These statements reflect the political opposition's interpretation of the reported internal exchanges and electoral-roll process.

BJP Defends the Election Commission

The BJP has rejected the Opposition's allegations.

BJP MP Sambit Patra defended the Election Commission and argued that correspondence between Election Commissioners showed that institutional deliberation was taking place.

He characterised the reported exchanges as part of normal democratic functioning rather than evidence of an institutional breakdown.

The disagreement therefore centres partly on how the reported internal objections should be interpreted.

What Were the Reported Objections About?

Reports concerning the Election Commission's internal exchanges have referred to several aspects of electoral-roll management.

These reportedly included voter additions and deletions, changes to Form 6 and questions concerning access to and management of electoral databases.

The reported objections have become significant because they involve members of the constitutional poll panel itself.

However, the Election Commission has said that such observations are part of the drafting and review process and do not mean that final decisions lacked the approval of the full Commission.

Mamata Also Calls for Pan-India Protests

Banerjee said protests should continue across the country while Gyanesh Kumar remains Chief Election Commissioner.

She described the issue as a broader political struggle concerning electoral institutions and democratic processes.

The TMC chief also indicated that INDIA bloc parties would meet to discuss the issue.

The proposed political mobilisation does not itself change the legal status of the Election Commission or the validity of the recently conducted elections.

TMC's Earlier Conflict With the Election Commission

The latest confrontation comes shortly after another dispute between the TMC and the Election Commission.

The poll panel recently froze the use of the All India Trinamool Congress name and the party's reserved twin-flowers-and-grass symbol amid an internal factional dispute.

For the October 6 bypolls, the Mamata Banerjee faction was given the name Mamata All India Trinamool Congress and the football-player symbol, while the rival faction led by Arup Roy received the name Democratic Trinamool Congress and the envelope symbol.

That dispute has added another layer to the TMC's confrontation with the poll panel.

What Does the EC Dissent Mean?

The reported objections by Sandhu and Joshi have generated questions about the internal decision-making process of the Election Commission.

However, an objection or note recorded during institutional deliberations is different from a final dissenting decision that invalidates an order.

The Election Commission has specifically said that all three commissioners approved its decisions relating to SIR.

The legal and institutional significance of the reported exchanges could therefore depend on the underlying documents and any subsequent judicial or parliamentary scrutiny.

What Happens Next?

The immediate political focus is likely to remain on the Election Commission's internal decision-making and the reported objections concerning SIR.

Opposition parties are expected to continue demanding action against the Chief Election Commissioner and greater scrutiny of the electoral-roll revision process.

The Election Commission, meanwhile, has maintained that its decisions were taken through the constitutional institution's established process.

Any decision to conduct fresh Assembly elections in West Bengal would have to come through the legally prescribed electoral process; Mamata Banerjee's demand alone does not trigger a repoll.

Bottom Line

Mamata Banerjee has demanded fresh West Bengal Assembly elections using the pre-SIR voter list and called for the arrest and resignation of Chief Election Commissioner Gyanesh Kumar. Her demands followed reports that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had raised objections to several decisions related to electoral-roll management and SIR.

The Election Commission has rejected the suggestion that the reported objections indicate a breakdown in its functioning, saying internal observations are part of normal institutional deliberations and that SIR decisions were taken unanimously.

The dispute is therefore currently a major political confrontation over electoral-roll revision and the functioning of the Election Commission. Banerjee's demand for a fresh election is a political demand, and no repoll has been ordered.
