Bombay HC convicts Tarun Tejpal in 2013 sexual assault case, overturns acquittal

The Bombay High Court on Tuesday convicted former Tehelka editor-in-chief Tarun Tejpal in the 2013 sexual assault case, overturning his acquittal by a Goa trial court. The High Court held that the earlier judgment warranted interference and directed that the matter proceed in accordance with law on sentencing.

Bombay High Court overturns Tarun Tejpal's acquittal in 2013 sexual assault case

In a significant development, the Bombay High Court on Tuesday convicted former Tehelka editor-in-chief Tarun Tejpal in the 2013 sexual assault case, setting aside the acquittal granted by a Goa trial court.

The High Court allowed the appeal challenging the trial court's 2021 verdict, holding that the acquittal could not be sustained after examining the evidence and circumstances of the case.

Acquittal reversed

The case stems from allegations made by a former colleague, who accused Tejpal of sexually assaulting her inside a hotel elevator during an event in Goa in November 2013.

A Goa sessions court had acquitted Tejpal in 2021, citing shortcomings in the prosecution's case. The verdict was later challenged before the Bombay High Court by the Goa government as well as the survivor.

After hearing detailed arguments, the High Court reversed the acquittal and found Tejpal guilty, paving the way for sentencing proceedings.

Case that sparked nationwide debate

The allegations against Tejpal had triggered widespread public debate on workplace sexual harassment and accountability, becoming one of India's most high-profile cases during the early years of the #MeToo discourse.

Following the complaint, Tejpal stepped down from his editorial responsibilities at Tehelka, and criminal proceedings were initiated under provisions of the Indian Penal Code.

Next step: Sentencing

With the conviction now recorded, the matter will move to the sentencing stage, where the court will determine the punishment to be imposed in accordance with the law.

Legal experts noted that Tejpal retains the right to challenge the High Court's judgment before the Supreme Court.

Significance of the verdict

The Bombay High Court's decision marks a major turn in a case that has remained under judicial scrutiny for more than a decade.

The verdict is expected to have wider significance for the handling of sexual assault cases and appeals against acquittals, reinforcing the judiciary's role in reviewing trial court findings where necessary.
